Understanding employment-based immigration law can be difficult. We’re here to answer your questions.

An EB-1 VISA is reserved for people of extraordinary or outstanding ability and multinational executives — this class can file a petition on their own behalf and need not obtain a labor certification from the Department of Labor.

EB-2 through EB-4 VISAS require the prospective employer to file a petition on behalf of the alien worker. The employer must also obtain certification from the Department of Labor that there are not sufficient workers in the United States able and willing to fill the position and that hiring a foreign worker will not adversely impact the wages and working conditions of similarly situated U.S. workers. Each type of application must also contain documentation of the applicant’s education and experience to substantiate his or her inclusion in that preference group.
