Understanding family immigration law can be difficult. We’re here to answer your questions.

Two groups of family-based immigrant visa categories, immediate relatives and family preference, are provided under the provisions of United States immigration law, specifically the Immigration and Nationality Act (INA). You can learn more about these two categories of immigrant visas on usvisas.state.gov.

  1. The United States Citizen Relative Files for I-130 Petition.
  2. Wait for Petition Approval.
  3. Acquire an Immigrant Visa Number from Dept. of State.
  4. Apply for Immigrant Visa in Home Country.
  5. Get Social Security Number.

You are an immediate relative if you are: The spouse of a U.S. citizen; The unmarried child under 21 years of age of a U.S. citizen; or. The parent of a U.S. citizen (if the U.S. citizen is 21 years of age or older).

After filing Form I-130, Petition for Alien Relative, the approval process can take anywhere from 6 to 12 months for immediate relatives and could take several years for family preference categories. This is an approximation. It may be shorter for some and longer for others.
